Terms of Service

The legally binding version of this document is the Bulgarian one. This English translation is provided for convenience only; in case of any discrepancy, the Bulgarian text prevails.

Summary

1. Parties and scope

These Terms of Service constitute a contract between the User and the Developer of the App and govern the conditions for using the App, the Website and the AI integration of "Vremcho".

By installing, launching or using the App, by using the Website or by using the Service through AI integration, the User makes an electronic statement declaring that they have read these Terms of Service, accept them and undertake to comply with them. If the User does not accept them, they should discontinue use of the Service.

Definitions

For the purposes of these Terms of Service, the following terms have the meanings set out below:

  • "App" — the "Vremcho" mobile application, available for Android and iOS
  • "Website" — the vremcho.com website, including the weather forecast pages described in section 2.2
  • "AI integration" — access to "Vremcho" data through ChatGPT and other AI assistants, as described in section 2.1
  • "Service" — all features, data and content provided through the App, the Website or through AI integration
  • "User" — any natural person who installs or uses the App, visits the Website or uses the Service through AI integration
  • "Developer" — the legal entity that developed and maintains the App and the Website

The provisions of sections 3 and 6–12 that refer to the App apply equally to the Website and to the Service provided through AI integration.

2. Description of the Service

"Vremcho" provides:

  • Current weather conditions
  • Hourly and daily forecasts
  • Precipitation alerts (for the coming hours)
  • Air quality (concentration of particulate matter and other pollutants), pollen, UV index and sea water temperature
  • Sunrise/sunset and moonrise/moonset times, as well as moon phases
  • Official weather warnings from government authorities
  • Radar and satellite imagery
  • Notifications for weather and other events configured by the User

The Service is provided for informational purposes only. It does not replace official weather bulletins and should not be used for decisions related to the User's safety.

2.1 Use through AI assistants

Part of the Service is also available through ChatGPT and other AI assistants that support the Model Context Protocol (MCP) ("AI integration"). Through it you can obtain current conditions, hourly and daily forecasts, air quality and pollen, sea water temperature and official warnings for a specific place in Bulgaria. It is free of charge and requires no "Vremcho" account. Notifications and short-term precipitation alerts are not available through the AI integration.

The AI assistant writes the answer you see in the conversation on the basis of the data we provide. The assistant may paraphrase, shorten, omit or inaccurately convey that data, or choose a place other than the one you meant. We are not liable for the way the assistant presents the data. If in doubt, check the place name in the answer or use the App directly.

Use of the assistant is also governed by the terms and privacy policy of its provider (e.g. OpenAI for ChatGPT). The data we receive through the AI integration is described in section 2.8 of the Privacy Policy.

2.2 Forecast on the website

The Website offers weather forecast pages for populated places, resorts, mountain peaks and huts in Bulgaria: current conditions, hourly and 14-day forecasts, air quality, pollen, UV index, sunrise and sunset, moon phases, sea water temperature, official warnings, as well as radar and satellite imagery. They are free of charge and require no "Vremcho" account. Notifications and short-term precipitation alerts are available only in the App.

The pages are refreshed every few minutes. In case of a technical problem they may temporarily show older data. The data processed when you visit the Website is described in section 2.9 of the Privacy Policy.

3. Accuracy of forecasts and warnings

3.1 No guarantees of accuracy

Forecasts and weather data are based on models and data from third parties. We do not guarantee that they will be accurate, complete, timely or free of omissions.

Precipitation alerts for the coming hours are purely informational — they may miss actual precipitation, warn about precipitation that does not occur, or arrive with a delay.

3.2 Official government warnings

Official weather warnings (yellow, orange and red codes) are issued by government authorities and are distributed by us as they are, without changes to their content. We do not guarantee timely delivery, completeness or availability of these warnings due to network problems, technical failures or delays at the provider.

The User should use the official information channels — NIMH, Civil Protection, BG-ALERT — as the primary and authoritative source during a severe weather event.

3.3 User responsibility

The User bears sole responsibility for decisions made on the basis of the information in the App, including decisions regarding travel, mountain trips and other outdoor activities, health and property. Conditions on mountain peaks and at huts may differ significantly from the forecast and change quickly. The User should not rely solely on the App for critical safety-related decisions.

4. Geographic scope

The Service provides information only for the territory of Bulgaria.

5. Licence

The Developer grants the User a limited, personal, non-transferable, non-exclusive licence to install and use the App on devices owned or controlled by the User, in accordance with these Terms of Service and the terms of the Google Play Store / Apple App Store, and to use the Website and the Service through AI integration for personal, non-commercial purposes.

Prohibited actions

The following are not permitted:

  • Reverse engineering, decompiling or sabotaging the App
  • Automated data extraction (scraping), including systematic downloading of the Website's forecast pages and bulk or systematic requests through AI integration or directly to it; ordinary use through an AI assistant in response to the User's questions and ordinary indexing by search engines are permitted
  • Redistributing data, alerts or imagery as a standalone paid or free service without prior written consent from the Developer of the App
  • Building a product or service based on the App's API without explicit written permission
  • Using the App in a way that violates applicable law or the terms of the data providers we use
  • Attempting to overload, attack or destabilise our infrastructure

6. Third-party services

The App relies on data from third parties — providers of weather models, radar and satellite imagery, air quality models, sea water temperature and others. We are not liable for errors, interruptions, delays or changes in the data flow from these providers.

Content provided by third parties is the intellectual property of the respective parties and is used in accordance with their terms.

7. Disclaimer of warranties

The App is provided "as is" and without express or implied warranties, including warranties of availability, accessibility or reliability.

We do not guarantee uninterrupted operation, absence of errors or availability at any particular moment. We are not liable for interruptions caused by circumstances beyond our control — force majeure, natural disasters, technical infrastructure failures, internet connectivity outages or the actions of third parties.

8. Limitation of liability

To the extent permitted by applicable law:

  1. We are not liable for direct, indirect, incidental or consequential damages arising from or related to the use of, or inability to use, the App.
  2. We are not liable for damages caused by inaccurate or untimely forecasts, warnings or data.
  3. We are not liable for decisions made by the User on the basis of the information in the App.

The law of the European Union and of the Republic of Bulgaria may provide mandatory User rights that cannot be excluded by the clauses above. Those rights remain in force.

9. Indemnity

The User undertakes to indemnify and hold the Developer harmless from claims, losses, costs (including legal fees) and damages arising from a breach of these Terms of Service or from unlawful use of the App.

10. Changes to the Service and termination of access

The Developer reserves the right to:

  • Add, change or remove individual features at any time
  • Temporarily interrupt or permanently discontinue the Service
  • Restrict or terminate access for Users who have breached these Terms of Service or abused the Service

In the event of material changes to the Terms of Service, the Developer shall notify Users through a notification in the App, on the Website or through an updated document date. Continued use of the Service after the changes take effect constitutes their acceptance.

11. Governing law and dispute resolution

These Terms of Service are governed by and construed in accordance with the applicable law of the Republic of Bulgaria.

All disputes between the parties shall be resolved in a spirit of understanding and good faith. If no agreement can be reached by mutual consent, the dispute shall be referred for resolution to the competent court in the Republic of Bulgaria. Users from the EU may also rely on the mandatory protective provisions of the consumer law of their country of residence.

12. Severability

If any clause of these Terms of Service is declared invalid or unenforceable, it shall be replaced by the applicable mandatory provisions of the law or established practice. The remaining clauses retain their full force and effect.
